1. Acceptance of Terms

By accessing and using TheXMedia's website and services, you accept and agree to be bound by these Terms and Conditions. If you do not agree to these terms, please do not use our services.

2. Services Description

TheXMedia provides short-form video content creation, social media management, personal branding, organic lead generation, CRM automation, SEO, performance marketing, and web development services. Our services are tailored primarily for professionals in real estate, law, finance, insurance, and other service industries across Canada, the USA, and Dubai.

3. User Responsibilities

As a client or user of our services, you agree to:

• Provide accurate and complete information when engaging with our services
• Protect the security of your account credentials
• Use our services only for lawful purposes
• Not interfere with or disrupt our platforms or operations
• Comply with all applicable laws and regulations in your jurisdiction

4. Payment Terms

All fees for services are agreed upon in writing prior to commencement of work. Payment is due as per the schedule outlined in your service agreement. All fees are non-refundable unless otherwise specified in writing. TheXMedia reserves the right to suspend services for accounts with outstanding balances beyond the agreed payment period.

5. Intellectual Property

TheXMedia retains ownership of all creative work, scripts, videos, and content produced until full payment has been received. Upon receipt of full payment, clients receive a licence to use the created materials for their intended purpose. Clients retain full rights to their original brand assets, logos, and pre-existing content provided to us.

6. Content and Accuracy

Clients are responsible for reviewing and approving all content before publication. TheXMedia produces content based on information provided by the client. We are not liable for inaccuracies arising from incorrect information supplied by the client. All content involving regulatory claims (financial, legal, medical) must be reviewed by the client prior to posting.

7. Confidentiality

Both parties agree to keep confidential any proprietary information, business strategies, client data, and trade secrets shared during the course of the engagement. This obligation continues after termination of the service agreement.

8. Limitation of Liability

TheXMedia shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from the use of our services, including but not limited to loss of revenue, loss of data, or reputational harm. Our total liability in any matter shall not exceed the fees paid by the client in the preceding 30 days.

9. Termination

Either party may terminate the service agreement with 30 days written notice. Upon termination, clients remain liable for any outstanding balances for work completed. TheXMedia will deliver all completed assets to the client upon receipt of final payment.

10. Governing Law

These Terms and Conditions are governed by the laws of the Province of Ontario, Canada. Any disputes arising from these terms shall be subject to the exclusive jurisdiction of the courts of Ontario.

11. Changes to Terms

TheXMedia reserves the right to modify these Terms and Conditions at any time. Updated terms will be posted on this page with a revised date. Continued use of our services after changes constitutes acceptance of the updated terms.
